Terms & Conditions

Please read these terms carefully before using the Atlys platform. By using our services, you agree to be bound by the terms below.

Acceptance of Terms
- By accessing or using the Atlys platform — including our website, mobile applications, and any related services — you agree to be bound by these Terms and Conditions and our Privacy Policy.
- If you do not agree with any part of these terms, you must discontinue use of the platform immediately.
- These terms apply to all users, including individuals applying for visas, business account holders, and any third parties acting on behalf of an applicant.
- Atlys reserves the right to update these terms at any time. Material changes will be communicated with at least 30 days' notice. Continued use after the effective date constitutes acceptance.

Our Services
- Visa Application Assistance: Atlys facilitates visa applications on your behalf by collecting required documents, completing application forms, and submitting them to the relevant government authority. We are an intermediary service — final visa decisions rest solely with the issuing authority.
- Application Tracking: We provide real-time status updates for applications submitted through our platform.
- AtlysProtect: An optional refund protection add-on that may cover our service fees in the event of a visa rejection. AtlysProtect does not cover government-imposed visa fees.
- Supplementary Tools: Features such as the Schengen Appointment Checker, Visa Photo Creator, and Itinerary Planner are provided as convenience tools. We do not guarantee their accuracy or completeness.
- Atlys does not guarantee visa approval. Approval is at the sole discretion of the relevant government authority.

User Obligations
- Accurate Information: You are solely responsible for the accuracy and completeness of all information and documents you provide. Submitting false, misleading, or fraudulent information is a violation of these terms and may constitute a criminal offence.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at security@atlys.com if you suspect unauthorised access.
- Age Requirement: You must be at least 18 years of age to create an account and use the platform independently. Minors may be included as dependants on an application managed by a qualifying adult.
- Prohibited Use: You may not use the platform to submit applications on behalf of third parties for commercial gain without express written agreement with Atlys.
- Compliance: You agree to comply with all applicable laws and regulations, including immigration laws of your origin and destination countries.

Fees & Payments
- Service Fees: Atlys charges a service fee for facilitating your visa application. This fee is separate from and in addition to any government-imposed visa fee.
- Government Fees: Visa fees charged by government authorities are collected by Atlys and paid directly to the relevant authority. These fees are non-refundable once an application has been submitted to the authority.
- Pricing: All fees are displayed in your selected currency before you confirm your application. Atlys reserves the right to modify service fees with reasonable notice.
- Payment Processing: Payments are processed by PCI-DSS compliant third-party providers. By submitting payment, you authorise Atlys to charge the stated amount to your selected payment method.
- Disputes: Any payment disputes must be raised with Atlys directly before initiating a chargeback. Unjustified chargebacks may result in account suspension.

Refunds & Cancellations
- Our refund policy is detailed in full on the Refunds Policy page. The following is a summary:
- Before Embassy Submission: You may cancel your application for a full refund of Atlys service fees before your application is submitted to the government authority.
- After Embassy Submission: Government fees are non-refundable once submitted. Atlys service fees are generally non-refundable at this stage unless AtlysProtect is active.
- AtlysProtect: Where purchased, AtlysProtect may cover Atlys service fees in the event of a visa rejection. See the Refunds Policy for full eligibility criteria.
- Refund requests must be submitted through the Atlys platform or by contacting support@atlys.com.

Intellectual Property
- All content on the Atlys platform — including text, graphics, logos, software, and data — is the property of Atlys Inc. or its licensors and is protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal, non-commercial purposes in accordance with these terms.
- You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the platform without our prior written consent.
- User-submitted content (e.g., documents, photographs) remains your property. By submitting content, you grant Atlys a licence to use that content solely for the purpose of processing your application.

Disclaimer of Warranties
- The Atlys platform is provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied.
- We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
- We make no representations regarding the likelihood of visa approval or the accuracy of processing time estimates, as these are determined by government authorities outside our control.
- Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

Limitation of Liability
- To the maximum extent permitted by law, Atlys and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
- Our total aggregate liability to you in connection with these terms shall not exceed the greater of: (a) the total Atlys service fees you paid in the 12 months preceding the claim, or (b) USD 100.
- These limitations apply regardless of the form of action, whether in contract, tort, or otherwise, and even if Atlys has been advised of the possibility of such damages.

Termination
- Atlys reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, if we reasonably believe you have violated these terms.
- You may close your account at any time through account settings or by contacting support@atlys.com. Pending applications will be handled in accordance with the refund policy in effect at the time of termination.
- Provisions that by their nature should survive termination — including intellectual property, disclaimer, limitation of liability, and governing law — shall survive.

Governing Law & Disputes
- These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
- Any dispute arising from or relating to these terms or the Atlys platform shall first be subject to informal resolution. Contact legal@atlys.com describing the dispute and proposed resolution.
- If informal resolution fails within 60 days, disputes shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except where prohibited by law.
- You waive any right to participate in class-action lawsuits or class-wide arbitration.
- Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
